Validity of the Terms and Conditions of Sale (TCS)

These Terms and Conditions of Sale (TCS), together with any order forms, framework contracts, or the privacy policy, govern the legal relationship between DREIER Jagdreisen GmbH, Büntenweg 527, CH-4245 Kleinlützel (seller), and its customers (buyers) regarding all sales contracts concluded between the parties, regardless of the method of conclusion. Additional provisions may apply to service deliveries. “DREIER HUNTING TOOLS” is a registered trademark. Provisions of the buyer that contradict these TCS are expressly excluded. By placing an order, the customer explicitly agrees to these TCS, the privacy policy, and other contractual elements.

Conclusion of the Contract

The seller’s offers on its website, in catalogs, brochures, etc., are non-binding. Price and assortment modifications as well as technical changes are possible. Product information such as technical data, images, and compatibility guarantees are based on manufacturer details and are non-binding for the seller. Errors and misprints are possible. By placing an order via mail, fax, telephone, email, or the online shop, the buyer makes a legally binding offer to conclude a contract. The contract is concluded through the seller’s explicit acceptance of this offer (e.g., via confirmation email, in the online shop’s customer account, or upon delivery). The buyer’s offer or the seller’s acceptance pertains to a single product at a time.

The contract is subject to the condition precedent of product availability and the buyer’s sufficient creditworthiness. Offers may be available in limited quantities. Model changes are reserved as long as the guaranteed features and purchase price remain unchanged. Prepaid amounts will be credited and refunded upon the buyer’s explicit request in the event of non-delivery.

The seller strives to indicate product availability and delivery times in the online shop. However, delivery delays may occur due to production or supply chain issues from the seller or third-party suppliers. Availability and delivery times are therefore non-binding and may change at any time.

Prices

All prices are listed in Swiss Francs (CHF), including VAT, or in Euros, excluding VAT. For business customers registered in the seller’s online shop who can claim input tax deductions, all prices are also shown excluding VAT. Time-limited promotions are valid only for the specified period.

Delivery and Shipping Costs

Parcel shipments are carried out via postal parcel service. Deliveries are made curbside or at ground level to the first door. Deliveries to upper floors, assembly work, or disposal services for goods purchased from the seller are not available.

For each order, the seller charges actual shipping costs. Customs clearance fees for international deliveries and applicable VAT are billed separately to the buyer.

In the event of a delivery delay exceeding 30 days, the buyer is entitled to cancel the contract. If the ordered item is unavailable, the seller reserves the right to offer the buyer an equivalent-quality and price item. The seller is not liable for delivery delays.

Payment

Accepted payment methods include credit and debit cards, TWINT, or bank transfer for invoiced purchases. The seller reserves the right to restrict certain items to credit card or prepayment purchases only. For credit/debit card payments, the card is charged upon order confirmation.

Retention of Title

Delivered goods remain the property of the seller until full payment is received.

Right of Withdrawal and Returns

Ordered goods can be returned within 14 days of receipt, along with the delivery note or invoice, at the buyer’s expense and risk, to the following address:

Refunds will be processed using the payment method employed during the purchase.

Special orders and used items are excluded from the right of withdrawal. Goods must be complete, in their original packaging, undamaged, unsealed, and resaleable. Otherwise, returns will be rejected, and items will be sent back to the buyer. Partial credits may be issued at the seller’s discretion. Cash refunds are excluded. Buyers receive a return receipt, and credit is issued within five business days.

Warranty

Unless otherwise stated, the warranty period for apparent and hidden defects is 24 months from the invoice date. The buyer must report apparent defects within 14 days of receipt and hidden defects within 14 days of discovery. Defective goods must be sent to the following address with a copy of the invoice and a detailed description of the defect:

Return shipping costs are borne by the buyer. Under warranty, the seller will decide whether to repair, replace, or issue a credit; price reductions may be agreed upon. Excluded from warranty are damages caused by the buyer, such as improper handling, natural wear and tear, or external factors beyond the seller’s control.

For out-of-warranty repairs, the seller provides a repair estimate at the buyer’s request. If the buyer proceeds with a paid repair or purchases a new device, any fees for the estimate are deducted from the final price. A two-year post-warranty applies to repaired product parts. Normal warranty periods apply to new replacement devices.

Liability

The seller’s liability for claims beyond warranty—regardless of the legal basis and to the extent permitted by law—is entirely excluded.

The seller is not liable for minor negligence, acts or omissions by auxiliary personnel or third parties, or pricing errors. The seller, its auxiliary personnel, and agents are not liable for damages unrelated to the goods, especially lost profits or other financial losses.

This liability exclusion does not apply to personal injury, intentional or gross negligence, or claims under product liability laws.

Data Protection

The seller commits to complying with applicable data protection laws when processing customer personal data.

Final Provisions

The seller reserves the right to modify the TCS at any time. Changes are communicated to the buyer via publication on www.dreier-hunting.com.

Offsetting claims is excluded.

If any provision of these TCS or other agreements is invalid, the validity of the remaining provisions and the contract as a whole remains unaffected.

In case of conflict, the German version of the contract prevails over the French version.

All obligations arising from this contractual relationship are subject to Swiss substantive law, excluding the UN Convention on Contracts for the International Sale of Goods and Swiss conflict-of-law rules.

The court of Solothurn has exclusive jurisdiction, subject to mandatory legal jurisdictions.
